The Islamabad High Court has ordered the session judge to re-hear Shahbaz Gul’s physical remand request and said that the session judge should hear the request and decide on its merits. Also listen.
According to the details, the Islamabad High Court, while giving a reserved decision on the remand petition of Tehreek-e-Insaf leader Shehbaz Gul, said that the petition of the Advocate General for re-examination is admissible. Acting Chief Justice Amir Farooq said in the judgment that the session judge should consider the application as admissible and decide on merit.
Acting Chief Justice Aamir Farooq in the judgment directed that the application of Dakar Shehbaz Gul should be combined with bail and the case should be heard. The Islamabad High Court had reserved its decision regarding the admissibility of the government’s request for physical remand of Shahbazgil. The prosecution had challenged the magistrate’s decision not to grant physical remand to the Tehreek-e-Insaaf leader.
Acting Chief Justice said that the accused belongs to a political party, the court has to look only at the legal point. During the hearing, the Islamabad High Court had stopped the lawyers from talking about politics in the Shahbazgul case. Acting Chief Justice Amir Farooq said that he is not going to the merits of the request for remand, he will hear the arguments first.
He has also requested that physical remand be given. The High Court does not remand. The court remarked that it is the job of the police to conduct the investigation and it has to be done by the Supervising Magistrate. The accused is always the favorite child of the court. It is not the jurisdiction of the High Court to see how much the accused should be remanded. Lawyer Shehbaz Gul argued that the High Court cannot interfere in the investigation and remand, to which the Acting Chief Justice said that we are not even interfering. The case has not yet been heard on the merits of remand. I will hear the arguments first when they are admissible.
